GENERAL TERMS AND CONDITIONS

These General Terms and Conditions of purchase (hereinafter the “GTC”) give guidelines regarding the access and the use of the website https://www.lasala.it/shop (hereinafter the “Site”) by the final users according to the applicable e-commerce laws and regulations.

The term final user indicates a physical person who is more than 18 years old who accesses and makes use of the Site; the person shall not act on behalf of a company and/or not for business or commercial purposes such as sale or resale etc. The person who will receive the delivery must also be  more than 18 years old (hereinafter the “Consumer”). To this aim, the user states and guarantees to be a physical person more than 18 years old. According to the laws and regulations on wine and alcohol, the Site hereby reserves the right, at its own discretion and without notice, to refuse services, close accounts, remove or modify content or cancel any order coming from users which are not Consumers.

The Site is offered as it is. Therefore it is not guaranteed that the Site will always be available online for access and use, or in the current format, or that the software is compatible with the users’ devices or that the materials published are accurate and updated.

The GTC regulates the purchase, delivery and withdrawal policy between the Customers and LA SALA. Any products different from the LA SALA brand products accessible on the Site via hypertext links, banners etc are excluded from this contract and LA SALA shall not be liable for any purchase made of such other products. By registering on the Site, the Customer accepts the reception of any communication on their e-mail but maintains the right to opt-out from the offers and promotions on the newsletter.

The Company makes shopping online available to the Customers by using its e-commerce service through which it is possible to purchase LA SALA products according to the present GTC.

The GTC can be periodically modified by the Company according to the development of its business, of the market or for legal requirements. Each update and modification will be regularly published on the Site and immediately effective from the date of publication.

HOW TO PURCHASE

Once registered, the Customer can access the Site where it is possible to choose the LA SALA products to purchase and make an order. Each order must be no fewer than 3 bottles. Orders are subject to availability. LA SALA hereby reserves the right not to accept all the orders, while the user maintains the right to receive the reimbursement of the entire purchase price and delivery expenses. The pictures and photos are an approximation and do not constitute a guarantee of product quality. Furthermore, the pictures and photos of the vintage on sale do not always show the actual vintage. The correct vintage is properly indicated in the product description.

The order is made through confirmation of the same and it is subject to payment of the price, taxes and shipping and any other payment costs indicated in the final summary. The order confirmation does not constitute acceptance of the order. The acceptance of the order and conclusion of the contract occurs when the Company sends the order confirmation to the email address provided by the Customer.

The price shown on the Site includes VAT and the cost of transport is shown separately, both on the order form and on the invoice. The same constitutes an offer to the public pursuant to art. 1336 of the Italian Civil Code, however the published prices may be subject to variation without notice: it will be the Customer’s duty to double check the final price before submitting the order.

TERMS OF PAYMENT

The accepted payment methods for the Company are as follows:

Prepaid Cards and Postepay credit cards;

Credit and debit cards through the main international circuits, managed by Xpay by Nexi.

Paypal, after confirmation of the order, the Customer will be redirected to the Paypal website where the Customer can make the transaction even if the Customer is not a registered user.

Bank Transfer: the transfer must be received within 10 days from the date of acceptance of the order. After this deadline the order will be automatically cancelled. Once the transfer has been credited, the order will be immediately processed and shipped. To this purpose, it is necessary to indicate the name and surname and the order number. All the financial information necessary for the transaction will be transmitted via encrypted protocol to the banks that provide the electronic payment services, without third parties having access to them. This information will never be used by the Company except to complete the procedures relating to the purchase and to issue the refunds in the event of any return of the products, wherein the customer exercises their right of withdrawal, or if necessary to prevent or report the commission of fraud to the police.

SHIPPING AND DELIVERY

Any purchase made on the Site is made pursuant to a shipment contract. Therefore, the risk of loss and the title of ownership on these orders is transferred to the Customer upon delivery to the carrier, id est UPS™ and/or Fedex™ and/or Mailboxes™ and/or Logistics srl.

The shipment can be tracked at any time thanks to the shipment code that will be provided at the time of purchase. Shipment costs may vary depending on destination and weight. Any local regulations could limit or prohibit the delivery of our product in some countries. Direct orders abroad may be subject to import taxes, customs duties and taxes taken from the destination country. The recipient of the international shipment may be subject to import taxes, customs duty and taxes levies upon arrival of the order to the recipient’s country. Any additional charges for customs clearance are the responsibility of the recipient. The Company has no control over these charges and is unable to predict their amount.

The Company declines all responsibility for delayed shipment or non-delivery due to force majeure. In such cases, the Company reserves the right to cancel the contract in whole or in part or to suspend it temporarily, until these obstacles are removed or clarified.

As customs policies differ greatly between countries, please request more information from your local office to avoid any inconvenience.  Where customs clearance procedures are required, the indicated delivery time may be delayed.  To find out the list of countries where deliveries are made and the relevant conditions, please see the Shipping page.

The list of interested countries could be subject to variations, therefore it is advisable to check the availability of the delivery before proceeding to complete the purchase order.

RIGHT OF WITHDRAWAL

No claims will be accepted after 14 days from the date of receipt of the shipment. Any disputes will be referred to the competent judicial authorities in the territory where the Company’s headquarters are located.

Purchase on the website www.lasala.it/shop are subject to the provisions of Legislative Decree 206/2005 and subsequent amendments which guarantees the right of withdrawal. Returned products must be intact, preferably in the original packaging: for damaged or altered products it will not be possible to exercise the right of withdrawal. This right is reserved only to Customers, therefore any purchase made by retailers or by persons who, for whatsoever reason, purchase for resale, remain excluded. To exercise this right the user must follow the following procedure:

The Customer shall send an email within 14 days from receipt of the goods and shall indicate:

  • Invoice number;
  • Order number;
  • Date of the order;
  • The product/s to withdraw;
  • Bank details (IBAN and SWIFT code) for the refund.

Wait for La Sala – Il Torriano snc, email authorization of the return.

Within 15 days from receipt of the authorization to return the product/s, ship the product that is subject to withdrawal to the following address: La Sala – Via Sorripa, 34 – 50026 San Casciano val di Pesa (FI).

The refund of the withdrawn product/s  will be carried out within 14 working days of receipt of the goods. Such refund shall not include the shipment costs that are at the expense of the Customer, according to art. 5 of the Legislative Decree n. 185 dated 22/05/1999.

In general, even if not expressly written, the legal provisions regarding long distance contracts shall apply. Any dispute is subject to the Italian Legislation and the Court of Florence will be solely applicable.

MISCELLANEOUS

CUSTOMER OBLIGATIONS

The Customer undertakes, once the online purchase procedure has been completed, to ensure the preservation of these GTC which, moreover, will have already been viewed and accepted as an obligatory passage in the purchase, as well as the specifications of the product that is the object of purchase, and this is in order to fully satisfy the condition of the articles 52 and 53 of Legislative Decree 2015/06 and subsequent amendment.

It is strictly forbidden for the Customer to enter false and/or fictional data in the registration procedure necessary to activate the procedure for the execution of this contract and the related further communications; the personal data and the email must be accurate and exclusively their own real personal data and not of any third parties, or fictional.  The Company cannot be responsible for false declarations and reserves the right to legally prosecute any violation or abuse of which it has become aware in the interest of and for the protection of all consumers. The Customer releases the Company from any liability arising from the issue of incorrect tax documents due to errors in the data provided by the Customer, being themselves solely responsible for the correct entry.

PROFILING

Use of data for a better and personalized service.

The Customer gives their consent to the Company to use the preferences expressed by the Customer while browsing online and send communications in relation to predilections, attitudes, interests perceived during navigation, in order to provide a personalized and better service. The personal data collected will be used and stored in accordance with the provisions of the Privacy Guarantor regarding communications relating to the storage of data for profiling and marketing purposes.
